TERMS & CONDITIONS

SERVICE USE

The customer undertakes to use this service in compliance with the laws and regulations in force that apply to it, as well as the Terms and Conditions set out herein.
ESMAGA may, at any time, change, in whole or in part, the Terms and Conditions set out here.
The customer may not change the content of the Service or send messages that contain abusive language, computer viruses or that may cause any other damage.
Online store customers are considered final consumers, subject to VAT assessment, with the exception of residents in third countries outside the European Union.
The sales process is subject to compliance with the rules defined by Law No. 25/2008 of 5 June, on the regime for preventing and repressing the laundering of illicit advantages and the financing of terrorism.

2. PRODUCTS IN THE ONLINE STORE

Products duly identified in the respective catalogs can be purchased in the online store.
The non-availability of a product in the online store does not mean that it is sold out at ESMAGA, and may be available through another brand distribution channel.


3. PRICES

The prices shown in the catalog include VAT at the legal rate in force at the time of purchase, plus the respective shipping costs.
The price of the products, the value of VAT and the cost of postage are all duly broken down before the final validation phase of the purchase.
Any other costs resulting from sending orders abroad, namely customs clearance costs, will be the sole responsibility of the purchaser of the product.
4. ORDER

The order of any product, chosen from those existing in the product catalog, is made by placing it in the shopping basket;
For some products, duly identified in the online store, the purchase may be limited to a certain number of copies.
The customer may cancel the order by email within 24 hours after ESMAGA has received the order confirmation.
The cancellation request will only take effect when the order number and the name of the customer are indicated.
If the customer wishes to return the ordered items to ESMAGA, after studying the reason and validating it, the purchase money will be refunded, but the postage already paid will not be refunded.
ESMAGA will bear the costs of return postage, when the item is damaged or if there has been an error in its shipment.
ESMAG reserves the right to cancel any order that it is unable to process.
5. PAYMENT METHODS
The products can be paid through the different electronic payment methods available in the online store.
ESMAGA reserves the ordered product for 24 hours, after which time, in case of non-confirmation of payment, the order may be cancelled.
6. DELIVERY TIME
In mainland Portugal, orders are delivered, as a rule, within 3 working days after the respective payment date;
In mainland Portugal deliveries are made by the carrier NACEX, for the islands the method used is CTT.
In the Autonomous Regions and, depending on the Islands, the delivery time can vary between 3 to 8 working days.
Deliveries in Europe and the rest of the world vary according to destination and transport time.
If there is a situation of out of stock, the customer will be informed before shipment.
If the selected shipping method is not registered, ESMAGA is not responsible for any damage or loss.
7. RETURN OF PRODUCTS
The delivery of products purchased through this service complies with the legal rules applicable in Portugal to distance commerce (Decree-Law No. 82/2008 of May 20).
To proceed with the return or exchange of items, you will have to fill in, in the Exchanges & Returns area, the mandatory fields for this purpose.
The Customer/User has the right to claim any defect, inaccuracy or inadequacy of the product in relation to what was ordered, within a period of 30 working days.
Must have proper proof of purchase.
The items must be returned in the same conditions in which they were received, without being altered by the Customer/User.
ESMAGA is not responsible for the cost of shipping and return of all orders returned due to multiple delivery attempts, insufficient address, or refusal.
8. ONLINE STORE REGISTRATION
Individual registration in the online store is carried out under "Registration".
This registration allows for an easier purchase process, with the recording of customer identification data, allowing immediate recognition of the same, without the need for new typing.
The Customer/User can update their personal data online whenever they make a purchase in the online store.
The Customer/User can subscribe to the Newsletters and receive all the news by email.
Access is restricted to each Customer/User and guaranteed by the use of a login and password.
After registration, this data is sent to the customer's e-mail to ensure confidentiality, with the Customer/User being solely responsible for its subsequent use.
9. PRIVACY AND SECURITY POLICY

ESMAGA collects the Customer/User's personal data for the purpose of managing the customer account, billing, provision of information, as expressly authorized for this purpose, assuming a commitment to privacy and security in the processing and maintenance of the personal data of each Customer/User, under the terms of Law n.º 67/98 of October 26th.
The entire payment process, from the selection of the payment method to the introduction of data inherent to the order payment process, is duly protected with appropriate electronic security tools.

10. APPLICABLE LAW AND JURISDICTION
Portuguese law applies to this agreement.
For the resolution of disputes arising from this contract, the jurisdiction of the Comarca de Felgueiras is competent, with express waiver of any other.
